<p style="text-align: justify;"><span style="color:#5f6a72;"><span class="titre_p" style="font-family:ITCAvantGardePro;font-size:18px;font-weight:900;">CONDITIONS CONCERNANT LE MANDATAIRE / <em>TERMS REGARDING THE AGENT</em></span></span></p> <p style="text-align: justify;"><span style="font-family:ITCAvantGardePro;font-size:12px;font-weight:200;">En conséquence du présent mandat, le mandataire : <span style="font-weight:600;"> As a result of this agreement, the agent:</span></span></p> <ul> <li style="text-align: justify;"><span style="font-family:ITCAvantGardePro;font-size:12px;font-weight:200;"><span class="titre_p">entreprendra les démarches et mettra en œuvre les moyens qu'il jugera nécessaires en vue de réaliser la mission confiée ; effectuera de la publicité par tout moyen ; <span style="font-weight:600;">will take whatever action and devote all resources that he or she deems necessary to provide the services requested;</span></span></span><br /> <span style="font-family:ITCAvantGardePro;font-size:12px;font-weight:200;"><span style="font-weight:600;">Si le mandataire, comme il y est autorisé, est amené à rédiger un acte sous seing privé en vue de réaliser l’achat de biens soumis aux exigences de l’article 46 de la loi du 10 juillet 1965 sur la copropriété</span>, il s’assurera de la fourniture par le vendeur d’un certificat établi par un homme de l’art (dûment couvert par une assurance en responsabilité civile professionnelle) indiquant la superficie de la partie privative des biens et le caractère actuel de celle-ci. À défaut, le mandataire procédera ou fera procéder au mesurage de la partie privative des biens à l’effet de reporter sa superficie dans l’acte.<br /> <span style="font-weight:600;">If the agent, as hereby authorized, is called upon the draft of any sales agreement that is subject to the requirements of Article 46 of the Condominium Act of July 10, 1965, he or she must make sure the seller provides a certificate prepared by a qualified professional (who must have liability insurance coverage) specifying the size in square meters of the part of the property intended for private use and the certificate must be recently issued. Otherwise, the agent must him or herself measure or cause someone to measure the part of the property intended for private use and the figure must be included in the sales agreement.</span></span><br /> <span style="font-family:ITCAvantGardePro;font-size:12px;font-weight:200;"><span style="font-weight:600;">Si le mandataire, comme il y est autorisé, est amené à rédiger un acte sous seing privé en vue de réaliser l’achat de biens situés dans des zones couvertes par un plan de prévention des risques technologiques ou des risques naturels prévisibles, prescrit ou approuvé, ou dans des zones de sismicité définies par décret en Conseil d’Etat</span>, il s’assurera, conformément à l’article L 1255 du code de l’environnement, de la fourniture par le vendeur d’un état des risques dressé sur la base des informations mises à disposition par la préfecture. À défaut, le mandataire procédera à l’établissement de l’état des risques à l’effet de l’annexer à l’acte. </span><br /> <span style="font-weight:600;"><span style="font-family: ITCAvantGardePro; font-size: 12px;">If the agent, as hereby authorized, is called upon the draft of any sales agreement for property located in an area that is subject to a prescribed or approved plan to prevent predictable technological risks or natural risks or that is in an area where there is seismic activity as defined by decree in the Council of State, he or she must make sure, by virtue of Article L 125-5 of France’s Environment Protection Code, that the seller provides a statement of risks prepared based on information made available by the local authorities (prefecture).
